Subscription, Refund and Cancellation Policy

This policy explains how subscriptions to ProRacer.ai (the Platform) are billed, how you can cancel, and the limited circumstances in which refunds apply. This policy forms part of our Terms of Service.
1. Subscriptions
The Platform is offered on a subscription basis. The features, usage limits, and price of each plan are shown on the pricing page at the time of subscription.
Unless stated otherwise, prices are quoted in Australian Dollars and are exclusive of any applicable taxes (such as GST), which will be added at checkout where required.
2. Free trial
New accounts may be eligible for a free trial period as advertised at the time of sign-up. At the end of the trial:
— You can subscribe to a paid plan to continue using paid features
— If you do not subscribe, your account may be placed in a limited-access state
— Data you have uploaded is not deleted solely because the trial ended
We may modify or discontinue the free trial at any time. Only one free trial is available per customer.
3. Billing
Subscriptions are billed in advance on a recurring basis (monthly or annually, depending on the plan you choose). Your subscription will automatically renew at the end of each billing period using the payment method on file unless you cancel before the next renewal date.
All payments are processed securely through Stripe. ProRacer does not store full payment card details on its servers.
4. Plan changes
You can upgrade or downgrade your plan at any time from your billing dashboard.
— Upgrades take effect immediately and are pro-rated for the remainder of the current billing period
— Downgrades take effect at the start of the next billing period
— Some features, limits, and stored data may become unavailable after a downgrade
5. Price changes
We may change subscription pricing from time to time. We will give you at least 30 days' notice of any price change that affects your plan. If you do not agree to the new price, you may cancel before the change takes effect.
6. Cancellation
You can cancel your subscription at any time from your billing dashboard. On cancellation:
— Your subscription will not auto-renew at the end of the current billing period
— You will retain access to paid features until the end of the period you have already paid for
— After the period ends, your account may be placed in a limited-access state
— Your data is retained in accordance with our Privacy Policy
7. Refunds — general position
ProRacer subscription fees are generally non-refundable. Because the Platform is a digital service that you can use immediately and continuously throughout each billing period, we do not provide refunds for:
— Unused time on a subscription you have cancelled
— A change of mind after a billing cycle has started
— Failure to cancel before an automatic renewal date
— Downgrades within a billing cycle
— Failure to use the Platform during a billing period
8. Refunds — Australian Consumer Law
Nothing in this policy limits any rights you have under the Australian Consumer Law. If the Platform fails to meet a consumer guarantee, you may be entitled to a repair, replacement, or refund. We will assess any such request in good faith and in accordance with applicable law.
9. Discretionary refunds
In addition to your rights under the Australian Consumer Law, we may at our discretion provide a refund or credit in certain circumstances, such as:
— Duplicate charges or other billing errors
— A clear, identifiable failure of paid functionality that we cannot resolve in a reasonable time
— Other situations we consider fair on a case-by-case basis
Discretionary refunds do not create any obligation to offer refunds in other situations.
10. Failed payments
If a renewal payment fails, we will attempt to charge the payment method on file again. If payment cannot be collected within a reasonable period, paid features may be suspended until the outstanding amount is paid. We may terminate accounts that remain in a failed-payment state for an extended period.
11. Account closure and data
You can close your account at any time. After account closure, your data is retained for a limited period to allow export and then permanently deleted in accordance with our Privacy Policy. Closing your account does not entitle you to a refund of fees already paid for the current billing period.
12. How to request a refund
To request a refund or raise a billing question, contact us at [email protected] with your account email and a description of the issue. We will respond within a reasonable period.
13. Changes to this policy
We may update this Subscription, Refund and Cancellation Policy from time to time. We will publish the updated version on the Platform with a revised "last updated" date. Continued use of the Platform after changes constitutes acceptance of the updated policy.
