Terms of service

1. Acceptance of terms

By accessing or using the Kodora motorsport intelligence platform ("Service"), you agree to be bound by these Terms of Service. If you are using the Service on behalf of an organisation, you represent that you have authority to bind that organisation to these terms.

2. Description of service

Kodora provides an AI-powered motorsport analytics platform that processes session data to generate performance insights, coaching recommendations, and strategic intelligence. The Service includes data upload, AI analysis, driver intelligence profiles, reporting, and team management features.

3. Accounts and registration

You must create an account to use the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You agree to provide accurate and complete information during registration and to keep it updated.

All accounts require multi-factor authentication (MFA). You must configure MFA during your first login.

4. Free trial

New accounts receive a 7-day free trial with full access to the selected plan's features. No credit card is required to start a trial. At the end of the trial, you must subscribe to continue accessing the Service. If you do not subscribe, your account will be placed in a limited view mode — no data will be deleted.

5. Subscription and billing

The Service is offered on a subscription basis with monthly or annual billing. Prices are as listed on the pricing page at the time of subscription. We reserve the right to change pricing with 30 days' notice.

Subscriptions renew automatically unless cancelled before the renewal date. You can upgrade, downgrade, or cancel your subscription at any time through the billing dashboard. Changes are prorated.

All payments are processed securely through Stripe. We do not store credit card details on our servers.

6. Your data

You retain ownership of all data you upload to the Service, including session telemetry, performance data, and any other content. By uploading data, you grant Kodora a licence to process, analyse, and store that data for the purpose of providing the Service.

Kodora builds driver intelligence profiles based on your uploaded data and interactions. These profiles are used exclusively to provide personalised insights for your team and are subject to strict tenant isolation.

7. Acceptable use

You agree not to:

— Use the Service for any unlawful purpose

— Attempt to gain unauthorised access to any part of the Service

— Interfere with or disrupt the Service or its infrastructure

— Reverse-engineer, decompile, or disassemble any part of the Service

— Share account credentials or allow unauthorised access to your account

8. AI-generated content

The Service generates AI-powered insights, recommendations, and analysis. While we strive for accuracy, AI-generated content is provided for informational purposes and should not be solely relied upon for safety-critical decisions. You are responsible for evaluating and acting upon any insights or recommendations provided by the platform.

9. Service availability

We aim to provide high availability but do not guarantee uninterrupted access. We may perform maintenance or updates that temporarily affect availability. We will provide reasonable notice of planned downtime where possible.

10. Limitation of liability

To the maximum extent permitted by law, Kodora shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to loss of data, revenue, or competitive advantage.

11. Termination

Either party may terminate this agreement at any time. You can cancel your subscription and delete your account through the platform settings. Upon termination, your data will be retained for 30 days to allow for export, after which it will be permanently deleted.

12. Governing law

These terms are governed by the laws of Australia. Any disputes arising from these terms or the Service shall be resolved in the courts of Victoria, Australia.
